The 29-year-old woman who has accused NBA star Derrick Rose of rape is seeking $21.5 million in damages, according to court documents.
via Chicago Tribune:
In court documents filed Monday, the attorney for the accuser, who is referred to as “Jane Doe,” seeks $15.5 million in punitive damages plus $6 million in compensatory damages. The attorney, Brandon Anand, also asked the court to award the woman $3,420 in attorney’s fees.
The case has shifted to U.S. District Court in Los Angeles after the initial lawsuit was filed Aug. 26 in Los Angeles County Superior Court. Rose’s attorney, Mark Baute, argues that state court does not have jurisdiction because Rose lived in Illinois at the time of the alleged assault.
Anand, in documents filed in federal court this week, attempts to build a case that Rose is a resident of Beverly Hills, Calif., and requests the case be moved back to state court. Included in the documents were reported text messages between Rose and the woman near the time of the alleged assault in which Rose refers to his address in Beverly Hills as “home.” Rose, Anand argues, essentially lives in the Los Angeles area when he is not needed in Chicago for basketball practices and games.
After Wednesday night’s game, Rose said the suit isn’t a distraction to him and he lets his attorneys handle it.
The attorneys for both sides met Oct. 19 to discuss the case, according to court documents, and agreed to exchange information by Nov. 2. A new court date is set for Dec. 7 in federal court.
