Walmart is firing back against a lawsuit filed by Tracy Morgan after a Walmart 18-wheeler rear ended Tracy’s limo, causing the death of one passenger and critically injuring Tracy.
Their response? It’s Tracy’s fault because he wasn’t wearing his seatbelt.
“Plaintiff’s injuries, if any, were caused … by plaintiff’s failure to properly wear an appropriate available seatbelt restraint device. By failing to exercise ordinary care in making use of available seatbelts … plaintiff acted unreasonably and in disregard of [their] own interests.”
Walmart’s response comes via court papers filed in New Jersey federal court Monday. Tracy’s attorney, Benedict Morelli, responded to Walmart’s claims saying:
“After Walmart told the public and their customers that they would take full responsibility, they put responsibility on my clients and the deceased — which I think is despicable. Tracy is struggling and struggling and he’s sitting in a wheelchair and they’re blaming him. It’s disgusting.”
Walmart’s response absolutely disgusting. The tuck driver responsible, Kevin Roper, pleaded not guilty to death by auto and assault by auto charges in state court.
